Mining

RWCS has done significant work relating to mining operations and environmental issues in various contexts, including the following: 
  • Defense of claims brought in New Mexico federal court relating to dispute over transfer of uranium mining environmental liabilities at large site in New Mexico. 
  • Representation of city's claims for damages caused by operation of former zinc smelter in Oklahoma.
  • Ten-year plus representation of zinc manufacturing company in major complex CERCLA remediation and RCRA corrective action enforcement and permitting matter in Bartlesville, Oklahoma; involvement in follow-on litigation with remediation contractor.
  • Representation of Fortune 500 company PRP at Superfund mine site in Arkansas.
  • Development of modern state-of-the art land reclamation plan at 4,000 acre proposed greenfield cement plant site in Missouri; plan includes restoration of 3.2 miles of intermittent streams in rugged hilly topography (significant involvement in concept, preparation, revision of plan as well as defending it in litigation).
  • Obtaining and successfully defending land reclamation permit for development of 100-year limestone quarry at 4,000 acre site in Missouri against vigorous challenge by environmental groups over period of two years, including 4-day hearing before state Department of Natural Resources ALJ followed by defense of litigation in state court including appeal to Missouri Supreme Court.
