Stormwater

RWCS attorneys have extensive experience with stormwater issues in permitting, enforcement, and litigation.  RWCS attorneys have reviewed and commented on numerous SWP3s (Stormwater Pollution Prevention Plans), advised on general and individual stormwater permits, consulted on technical studies for stormwater programs, defended enforcement actions including notices of violation, and defended litigation involving allegations of pollution resulting from stormwater runoff.  An example of a case handled by RWCS involving allegations of stormwater program violations is Thompson v. Western Farmers Electric Cooperative.  The case involved extensive discovery relating to alleged stormwater violations including expert studies and reports, and depositions of numerous individual fact witnesses and experts.
