Water Rights


Do you have a surface water rights issue?  Water rights issues are becoming more and more important in Oklahoma and other states.  Despite wet months or sometimes even wet years, many areas in Oklahoma are experiencing moderate to severe long-term dry conditions.  Growth combined with water supply shortfalls is leading some Texas communities to attempt to either gain water rights or purchase water in Oklahoma.  See, e.g., Tarrant Regional Water District v. Herrman, Case No. CIV-07-45-HE, W.D. Okla. (filed Jan. 2007; scheduled for trial Dec. 2009).  RWCS attorneys are very experienced with Oklahoma's prior appropriation system of water rights (as modified by the riparian domestic use doctrine) and current water rights and water supply issues in Oklahoma and Texas.  RWCS attorneys have worked with the Oklahoma Water Resources Board on a variety of issues.  Keith Klein and Mark Coldiron have represented clients in Oklahoma with regard to many water rights issues, including obtaining and amending water rights permits, sale or transfer of water rights in-state and out-of-state (including current Oklahoma moratorium on out-of-state sales), Army Corps of Engineer water storage contracts, reservoir firm yield determinations, and even Indian claims to water ownership.  Keith Klein has spoken for the National Business Institute on water rights.
